1. Acceptance of Terms

By downloading, installing, or using Pawrtrait ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

Pawrtrait is an iOS application that uses artificial intelligence to transform pet photos into artistic portraits. The App provides both free and premium features.

3. User Accounts

The App creates an anonymous account upon first use. You are responsible for maintaining access to your device, as anonymous accounts cannot be recovered if access is lost. Do not share your device with others if you wish to keep your portraits private.

4. Free and Premium Tiers

Free Tier: All users receive 3 free portrait generations per month and access to select art styles (Cartoon, Pop Art).

Premium Tier: Subscribers receive unlimited portrait generations and access to all art styles, including premium and seasonal styles. Subscriptions are available on a weekly or yearly basis.

5. Subscriptions & Payments

• Subscriptions are billed through your Apple ID via the App Store
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your App Store account settings
• No refunds are provided for partial subscription periods, in accordance with Apple's refund policies

6. User Content

Your Photos: You retain all rights to photos you upload. By using the App, you grant us a limited license to process your photos through our AI service solely for the purpose of generating portraits.

Generated Portraits: AI-generated portraits are provided for your personal, non-commercial use. You may share, save, and post generated portraits on social media. You may not sell AI-generated portraits or use them for commercial purposes without our written consent.

7. Acceptable Use

You agree not to:

• Upload photos that do not depict animals or that contain inappropriate content
• Attempt to circumvent free tier usage limits
• Reverse-engineer, decompile, or attempt to extract the source code of the App
• Use the App to generate content that is illegal, harmful, or infringes on others' rights
• Use automated tools or bots to interact with the App

8. AI-Generated Content

Portraits are generated by artificial intelligence and may not always produce expected results. We do not guarantee specific outcomes. AI-generated content may occasionally contain artifacts or unexpected elements. We are not responsible for how generated images are used after they leave the App.

9. Intellectual Property

The App, including its design, code, branding, and AI models, is owned by Pawrtrait. The "Pawrtrait" name, logo, and associated marks are our intellectual property. These Terms do not grant you any rights to our intellectual property except the limited license to use the App.

10. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that AI-generated portraits will meet your expectations.

11. Limitation of Liability

To the maximum extent permitted by law, Pawrtrait shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or device damage.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the App ceases immediately.

13. Changes to Terms

We may update these Terms from time to time. Changes will be reflected by the "Last updated" date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction.
